The Telecom Disputes and Settlement and Appellate Tribunal (TDSAT) has called Reliance Communications (RCom) greedy, while rejecting its plea to roll out its newly-launched pan-India GSM services in six forbidden circles.
The Anil Ambani company earlier moved to the telecom tribunal to fight against trhe Department of Telecommunication`s (DoT`s) decision to forbid the company from launching the services in six circles - Bihar, Himachal Pradesh, Madhya Pradesh, Orissa, Kolkata and West Bengal.
The reason is that in these six circles, RCom has already been present in the GSM business through its subsidiary, Reliance Telecom, under the brand name of Smart.
RCom earlier claimed that it paid the hefty sum of $23 million (Rs112.56 crore) as an entry fee for these six circles. However, the DoT refunded the amount to RCom a month back.
Justice Arun Kumar observed that RCom had already accepted the money refunded by the government "without demur" or objection.
Kumar used strong words against RCom, saying, "You seem to be greedy. Your acceptance of the money returned by the government means you have lost the ground. The issue is closed. You have accepted the money."
The tribunal in its ruling said that having accepted the refunded money, the grounds of denial of start-up spectrum regarding six circles by the respondent [the DoT] seems justified, and the tribunal found no merit in the petition.
